Tensions are rising over the awarding of the Africa Cup of Nations to Morocco following Faustino Varela Monteiro’s op-ed in L’Observateur.
The vice-chairman of the CAF Appeals Committee publicly expresses his disagreement with the organization’s official line.
In his view, questioning the facts established during the matches constitutes a major procedural error that undermines institutional authority.
Monteiro places particular emphasis on the primacy of the refereeing body to justify his technical opposition. He reiterates a fundamental rule of sports:
“I strongly disagree with the decision. The facts described in the match official’s reports are presumed to be true and accurate until proven otherwise. If discrepancies arise, the referee’s report takes precedence on the field.”
Finally, the official warns that this decision could prove tenuous before international legal bodies.
He emphasizes that the Court of Arbitration for Sport (CAS) generally adheres to a doctrine of non-interference, except in cases of flagrant injustice.
“The CAS will not review a decision made on the field unless there is evidence of arbitrariness or bad faith, even if the decision appears erroneous in hindsight.”

For example, if the Appeal Committee is made up of 7 people and 4 voted or decided against Senegal (that represent majority), the votes/decisions of the therr(3) people who voted in favour of Senegal will not be enough to overturn the decisions of the 4 members of the committee especially where the Chairman supported

He knew the law stipulates that a walk out of the field of play equates 3point and 3 goals to the opposition team. Who handed the medals and winners' cup over to the Senegalese team after the match? It was displayed on CAF's website that Senegal were the latest AFCON Champions, until Morocco raised their allegations. Does it mean it took a protest from Morocco for CAF to remember their own laws? The same laws that weren't implemented on the field of play. And, it took them months to wake from their slumber. Should CAF just admit it was an error on their part? Africa my Africa!

Morocco wants to be afcon champion at all cost. the hand writing was on the wall. from referees awarding them dubious decisions, to stealing of opposing goal keepers towel. infact morocco are the worst ever host of afcon. this is not how Tunisia, vote D'Ivoire hosted and won. all African teams especially the west African teams should refuse to participate in the afcon if Morocco are awarded the trophy they couldn't win on the pitch. I hate Morocco with so much passion, now.
